Article 1 Purpose
These terms and conditions aim to define the rights, obligations, and responsibilities of the cyber mall and the user in relation to the use of internet-related services (hereinafter referred to as "Service") provided by Seongho S&I Corporation (hereinafter referred to as "Company") and operated by the Seongho S&I Corporation shopping mall (hereinafter referred to as "Mall").
※ "These terms also apply to electronic commerce conducted using PC communications, wireless, etc., provided that they do not contradict the nature of these terms."
Article 2 Definitions
The term "Mall" refers to the virtual sales place set up by the "Company" for the trading of goods or services (hereinafter referred to as "Goods, etc.") using information and communication equipment such as computers, and is also used to denote the business entity operating the cyber mall.
The term "User" refers to members and non-members who access the "Mall" and receive the services provided by the "Mall" according to these terms.
The term 'Member' refers to a person who has registered as a member of the "Mall" and can continuously use the services provided by the "Mall".
The term 'Non-member' refers to a person who uses the services provided by the "Mall" without joining as a member.
Article 3 Disclosure, Explanation, and Amendment of Terms
The "Mall" will post the contents of these terms, along with the company name, representative's name, address of the business office (including the address where consumer complaints can be handled), telephone number, fax number, email address, business registration number, mail order business registration number, and personal information management person, on the initial service screen of the cyber mall so that users can easily know. However, the contents of the terms may be made available to users through a linked screen.
Before agreeing to the terms, the "Mall" must provide separate linked screens or pop-up screens to ensure that the user understands important contents such as withdrawal of offers, delivery responsibilities, and refund conditions as specified in the terms.
The "Mall" may revise these terms within the limits that do not violate relevant laws such as the Act on the Protection of Consumers in Electronic Commerce, etc., the Act on the Regulation of Terms and Conditions, the Electronic Documents and Transactions Act, the Electronic Financial Transactions Act, the Electronic Signature Act, the Act on Promotion of Information and Communication Network Utilization and Information Protection, etc., the Door-to-Door Sales Act, and the Basic Consumer Act.
If the "Mall" revises the terms, it will notify users of the effective date and reasons for the revision along with the current terms on the initial screen of the mall at least 7 days before the effective date. However, if the terms are revised in a manner disadvantageous to users, a notice period of at least 30 days will be provided. In such cases, the "Mall" will clearly compare the contents before and after the revision to make it easy for users to understand.
When the "Mall" revises the terms, the revised terms will only apply to contracts concluded after the effective date, and the terms before the revision will continue to apply to contracts concluded prior to the revision. However, if a user who has already concluded a contract wishes to apply the revised terms, they must send their intention to the "Mall" during the notice period for the revised terms in Article 3 and receive consent from the "Mall" for the revised terms to apply.
Matters not specified in these terms and the interpretation of these terms will follow the Act on the Protection of Consumers in Electronic Commerce, etc., the Act on the Regulation of Terms and Conditions, the "Consumer Protection Guidelines in Electronic Commerce, etc." set by the Fair Trade Commission, and relevant laws or customary practices.
Article 4 Provision and Change of Service
The "Mall" performs the following tasks.
Providing information about goods or services and concluding purchase contracts
Delivery of goods or services for which purchase contracts have been concluded
Other tasks determined by the "Mall"
The "Mall" may change the content of goods or services to be provided under future contracts in cases of out-of-stock goods or changes in technical specifications. In such cases, the changed content and delivery date of the goods or services will be immediately posted on the place where the current content of the goods or services is displayed.
If the "Mall" changes the content of the services agreed upon in the contract with the user due to reasons such as out-of-stock goods or changes in technical specifications, the reason will be immediately notified to the user at the address where notification is possible.
Article 5 Suspension of Service
The "Mall" may temporarily suspend the provision of services in cases where maintenance, replacement, or malfunction of computer or information and communication equipment, or communication disruptions occur.
The "Mall" will compensate for any damages incurred by users or third parties due to temporary suspension of service as mentioned in Paragraph 1. However, this does not apply if the "Mall" proves there was no intention or negligence.
In cases where the service cannot be provided due to reasons such as changes in business items, abandonment of business, or integration of companies, the "Mall" will notify users in accordance with Article 8 and compensate consumers according to the conditions originally presented by the "Mall." However, if the "Mall" does not notify the compensation criteria, it will provide users with goods or cash equivalent to the value of the mileage or points in the "Mall."
Article 6 Membership Registration
Users apply for membership registration by filling out membership information in the registration form provided by the "Mall" and expressing their consent to these terms.
The "Mall" will register users as members, unless they fall under any of the following conditions:
If the applicant has previously lost membership according to Article 7, Paragraph 3, but has received approval for re-registration from the "Mall" after three years have passed since losing membership, they are an exception.
If there is false information, omission, or error in the registration details
If it is deemed that registration as a member significantly obstructs the "Mall's" technology
The establishment of the membership contract is considered to be the time when the "Mall" accepts the membership and notifies the member.
If there are changes to the information registered at the time of membership registration, the member must notify the "Mall" of such changes within a reasonable period by modifying the membership information or through other methods.
Article 7 Membership Withdrawal and Loss of Eligibility
Members can request withdrawal from the "Mall" at any time, and the "Mall" will process the withdrawal immediately.
If a member falls under any of the following reasons, the "Mall" may restrict or suspend their membership:
If false information was registered at the time of application
If the member fails to pay for goods purchased or other debts related to the use of the "Mall" by the due date
If the member interferes with or misuses the "Mall" or threatens the electronic commerce order
If the member engages in activities prohibited by laws or regulations or against public order and morals using the "Mall"
If the same behavior is repeated more than twice or the issue is not corrected within 30 days after the "Mall" restricts or suspends membership, the "Mall" may terminate the membership.
If the "Mall" terminates membership, it will delete the member's registration. In such cases, the "Mall" will notify the member and provide at least 30 days for the member to provide an explanation before deleting the registration.
Article 8 Notification to Members
When the "Mall" gives notice to members, it may do so to the email address designated by the member in advance.
For notifications to an unspecified number of members, the "Mall" may substitute individual notices by posting on the "Mall" bulletin board for more than one week. However, individual notifications will be made for matters that have a significant impact on the member's transactions.
Article 9 Purchase Application
"Mall" users apply for purchases using the following or similar methods, and the "Mall" must clearly provide the following information when users apply for purchases:
Searching for and selecting goods
Entering the recipient's name, address, phone number, email address (or mobile phone number)
Confirmation of terms, services with limited withdrawal rights, costs such as shipping and installation fees
Agreement to these terms and indication of confirmation or rejection of the above items (e.g., mouse click)
Application for purchase of goods and agreement to confirmation or verification of the "Mall"
Selection of payment method
If the "Mall" needs to provide or entrust the buyer's personal information to a third party, it must obtain the buyer's consent at the time of the actual purchase application, and does not obtain broad consent during membership registration. At this time, the "Mall" must specify the items of personal information provided, the recipients, the purpose of use of the recipients' personal information, and the retention and usage period. However, in cases of personal information processing consignment according to Article 25, Paragraph 1 of the "Act on Promotion of Information and Communications Network Utilization and Information Protection," relevant laws and regulations apply.
Article 10 Formation of Contract
The "Mall" may not accept purchase applications as mentioned in Article 9 if any of the following conditions are met. However, if entering into a contract with a minor, the "Mall" must notify that the minor or their legal representative may cancel the contract if consent from the legal representative is not obtained.
If there is false information, omission, or error in the application
If a minor purchases goods and services prohibited by the Youth Protection Act
If it is deemed that accepting the purchase application significantly hinders the "Mall's" technology
The contract is considered to be established when the "Mall's" acceptance reaches the user in the form of a receipt confirmation notice as specified in Article 12, Paragraph 1.
The "Mall's" acceptance must include information on the confirmation of the user's purchase application, the availability of the product, and corrections or cancellations of the purchase application.
Article 11 Payment Methods
Payment methods for goods or services purchased from the "Mall" may be made using one of the following available methods. However, the "Mall" may not charge any additional fees under any pretext for the payment of goods.
Various account transfers such as phone banking, internet banking, and mail banking
Various card payments such as prepaid cards, debit cards, and credit cards
Online bank transfers
Payment by electronic money
Payment upon receipt
Payment by points such as mileage granted by the "Mall"
Payment by gift certificates contracted with or recognized by the "Mall"
Other electronic paymen t methods
Article 12 Confirmation of Receipt, Changes, and Cancellation of Purchase Requests
The "Mall" will send a confirmation of receipt to the user when there is a purchase request.
The user who received the confirmation of receipt can request to change or cancel the purchase request immediately after receiving the confirmation if there is a discrepancy in the expression of intent, and the "Mall" must process the request without delay if it is made before delivery. However, if payment has already been made, the provisions regarding withdrawal of offers in Article 15 shall apply.
Article 13 Supply of Goods
Unless otherwise agreed upon regarding the timing of the supply of goods, the "Mall" will take necessary measures such as order production and packaging to ensure that the goods are delivered within 7 days from the date of the purchase request. However, if the "Mall" has already received all or part of the payment for the goods, measures will be taken within 3 business days from the date of receipt of payment. In this case, the "Mall" will take appropriate measures to allow the user to confirm the supply procedure and progress of the goods.
The "Mall" will specify the delivery method, the party responsible for delivery costs by method, and the delivery period for the goods purchased by the user. If the "Mall" exceeds the agreed delivery period, it must compensate the user for any resulting damages. However, this does not apply if the "Mall" proves that there was no intentional or negligent fault.
Article 14 Refunds
If the "Mall" cannot deliver or provide the goods due to reasons such as stockouts, it will promptly notify the user of the reason and, if payment for the goods has been received in advance, will refund or take necessary measures for a refund within 3 business days from the date of receipt of payment.
Article 15 Withdrawal of Offers
A user who has entered into a contract for the purchase of goods with the "Mall" may withdraw the offer within 7 days from the day the user receives the written contract content in accordance with Article 13 (2) of the "Act on Consumer Protection in Electronic Commerce, etc." (or from the day the goods are received or the supply of goods starts if it is delayed compared to receiving the written contract content). However, if there are provisions contrary to the "Act on Consumer Protection in Electronic Commerce, etc." regarding the withdrawal of offers, such provisions shall apply.
A user cannot return or exchange goods if any of the following conditions apply after receiving the goods:
1. If the goods are lost or damaged due to reasons attributable to the user (however, if the packaging of the goods is damaged to check the contents, the withdrawal of the offer is possible).
2. If the value of the goods has significantly decreased due to use or partial consumption by the user.
3. If the value of the goods has significantly decreased to the point where resale is difficult due to the passage of time.
4. If the original goods can be replicated with the same performance and the packaging of the original goods is damaged.
5. If the "Mall" did not take measures such as clearly stating the limitations on withdrawal of offers in an easily noticeable place or providing trial products, the withdrawal of the offer by the user is not restricted.
6. Despite the provisions of paragraphs 1 and 2, if the contents of the goods differ from the displayed or advertised content or if the goods are executed differently from the contract content, the user can withdraw the offer within 3 months from the date of receiving the goods or within 30 days from the date the user knew or could have known about the fact.
Article 16: Effects of Withdrawal of Subscription
"Mall" will refund the payment for goods or services within 3 business days of receiving the returned items from the user. If "Mall" delays the refund, it will pay the delayed interest calculated by multiplying the delay period by the delay interest rate specified in Article 21-2 of the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce.
When refunding the payment, if the user has paid the amount for goods or services using a credit card or electronic payment, "Mall" will promptly request the provider of the payment method to stop or cancel the billing for the goods or services.
In cases of withdrawal of subscription, the user will bear the costs necessary for returning the goods or services. "Mall" will not claim penalty or damages from the user for withdrawal of subscription. However, if the goods or services differ from what was advertised or if the contract is not fulfilled as agreed, "Mall" will bear the costs for returning the goods or services.
If the user has borne the shipping cost when receiving the goods or services, "Mall" will clearly indicate who bears the cost in case of withdrawal of subscription.
Article 17: Privacy Protection
"Mall" collects only the minimal amount of personal information necessary to provide services when collecting personal information from users.
"Mall" does not collect information required for the performance of a purchase contract at the time of membership registration. However, if personal identification is required before the purchase contract according to relevant laws, minimal specific personal information may be collected.
"Mall" will inform the user of the purpose of collecting and using personal information and obtain consent from the user.
"Mall" will not use the collected personal information for purposes other than the stated ones, and if a new purpose arises or if it is provided to a third party, it will inform the user of the purpose and obtain consent at the stage of use or provision. However, exceptions are made as stipulated by relevant laws.
If "Mall" needs to obtain the user's consent according to paragraphs 3 and 4, it must specify or notify the information management officer’s identity (affiliation, name, and phone number, other contact information), the purpose of collection and use of the information, and information provision to third parties (recipient, purpose, and content of information to be provided) as stipulated in Article 22(2) of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. The user may withdraw their consent at any time.
The user may request to view and correct errors in their personal information held by "Mall" at any time, and "Mall" is obligated to take necessary actions without delay. If the user requests correction of errors, "Mall" will not use the personal information until the error is corrected.
"Mall" must limit the handling of personal information to the minimum necessary for privacy protection and is responsible for any damage caused by loss, theft, leakage, unauthorized provision to third parties, or tampering of users' personal information, including credit card and bank account information.
"Mall" or third parties who receive personal information from "Mall" must destroy the personal information without delay when the purpose of collection or provision is achieved.
"Mall" will not set the consent for the collection, use, or provision of personal information as pre-selected. Additionally, it will specify the services restricted if the user refuses to consent to the collection, use, or provision of non-essential personal information and will not limit or refuse service provision, such as membership registration, based on the refusal.
Article 18: Obligations of the "Mall"
"Mall" must not engage in any activities prohibited by laws or regulations or contrary to public order and morals, and must make every effort to provide goods and services continuously and reliably as stipulated in these terms and conditions.
"Mall" must have a security system in place to protect users' personal information (including credit information) to ensure safe use of internet services.
If "Mall" engages in unfair labeling or advertising practices as defined in Article 3 of the Act on Fair Labeling and Advertising, causing damage to users, it will be responsible for compensation.
"Mall" will not send unsolicited commercial emails that the user does not wish to receive.
Article 19 Responsibilities for ID and Password
Except in cases outlined in Article 17, the responsibility for managing IDs and passwords lies with the member.
Members must not allow third parties to use their ID and password.
If a member becomes aware that their ID or password has been stolen or is being used by a third party, they must immediately notify the "mall" and follow any instructions provided by the "mall."
Article 20 Obligations of Users
Users must not engage in the following actions:
Registration of false information during application or modification
Theft of others' information
Modification of information posted on the "mall"
Transmission or posting of information other than that specified by the "mall" (e.g., computer programs)
Infringement of intellectual property rights of the "mall" or third parties
Actions that damage the reputation or disrupt the operations of the "mall" or third parties
Publicly displaying or posting obscene or violent messages, images, voices, or other information contrary to public morals on the "mall"
Article 21 Relationship Between Linked "Malls" and Linked-to "Malls"
When a higher-level "mall" and a lower-level "mall" are linked through methods such as hyperlinks (e.g., hyperlinks include text, images, and video), the former is referred to as the "linked mall" (website) and the latter as the "linked-to mall" (website).
If the "linked mall" explicitly states on its initial screen or a popup at the time of linking that it does not take responsibility for transactions conducted with the "linked-to mall," it will not be liable for those transactions.
Article 22 Attribution and Use Restrictions of Copyright
Copyright and other intellectual property rights for works created by the "mall" belong to the "mall."
Users must not use or allow third parties to use information that belongs to the "mall" by reproducing, transmitting, publishing, distributing, broadcasting, or using it for commercial purposes without the prior consent of the "mall."
The "mall" must notify the user if it uses the user's copyright according to an agreement.
Article 23 Dispute Resolution
The "mall" will establish and operate a compensation processing organization to reflect legitimate opinions or complaints raised by users and handle compensation.
The "mall" will prioritize handling complaints and opinions submitted by users. However, if quick processing is difficult, the "mall" will immediately notify the user of the reasons and processing schedule.
If there is a request for damage relief related to e-commerce disputes between the "mall" and users, the dispute resolution may follow the mediation of the Fair Trade Commission or a dispute mediation organization appointed by the city or provincial governor.
Article 24 Jurisdiction and Governing Law
Lawsuits related to e-commerce disputes between the "mall" and users will be governed by the user's address at the time of filing. If the address is not available, the case will fall under the exclusive jurisdiction of the district court that has jurisdiction over the residence. However, if the user's address or residence is unclear at the time of filing or if the user resides abroad, the lawsuit will be filed with the court designated by the Civil Procedure Act.
Lawsuits filed between the "mall" and users regarding e-commerce will be governed by Korean law.
Enforcement Date and Others
These terms and conditions will be effective from February 22, 2024.
These terms and conditions comply with the Standard Terms and Conditions for E-Commerce (Internet Cyber Mall), Standard No. 10023 (Revised on September 19, 2014).
